What to Do After a Car Accident in California: Step-by-Step

The exact steps to take after a crash in California — from the scene to the repair shop — so you don't get taken advantage of.

Most people deal with a car accident once or twice in their life. Insurance companies and shops deal with thousands. Here's how to level the playing field.

At the Scene

  1. Check for injuries first. Call 911 if anyone is hurt.
  2. Move to safety if the cars are drivable.
  3. Call police — a police report protects you later, even for minor accidents.
  4. Photograph everything: all vehicles, damage, license plates, the scene, skid marks.
  5. Exchange info: name, phone, insurance, license plate, driver's license number.
  6. Never admit fault at the scene. Just stick to facts.

Within 24 Hours

  1. File your insurance claim. Call your insurer — most have 24/7 lines.
  2. Get a repair estimate. You have the legal right in California to choose your own shop. The insurance company's "preferred" shop is their choice, not yours.
  3. Document everything — claim number, adjuster name, every conversation.

Choosing a Repair Shop

California law says you pick the shop, not the insurance company. Look for: OEM or quality aftermarket parts (ask which), a written warranty, ADAS recalibration if your car has driver-assist features, and direct insurance billing so you're not fronting the cost.

What About a Rental Car?

If the other driver was at fault, their insurance should cover a rental. If it was your fault, it depends on your policy — check if you have rental reimbursement coverage. We help coordinate rentals for our customers either way.
